Letter to the Editor:

An article in the March 19 edition of the Peshtigo Times regarding Bellin Health's lawsuit against Bay Area Medical Center requires some clarification.

Bellin isn't an organization that files a lot of lawsuits. However, there are times when there is no other recourse.

Our lawsuit is not about BAMC choosing to partner with Aurora. However, in doing so, BAMC must abide by the terms of our mutual agreement.

When Bellin and BAMC formed NorthReach Healthcare in 2000, we both committed significant resources. NorthReach operates primary care health clinics in several counties within Northeast Wisconsin and in Menominee County, Michigan. The organization was formed to address the future healthcare needs of the region.

Bellin and BAMC defined our partnership with an operating agreement. Specifically, the agreement includes terms that provide certain rights to the parties if Bellin Health or BAMC enter into certain joint ventures or affiliations with Aurora Healthcare, a Milwaukee-based healthcare provider.

Last fall, BAMC announced publicly it is negotiating a strategic partnership with Aurora. In the lawsuit, Bellin Health is seeking a declaration from the court whether BAMC's actions with respect to Aurora trigger certain rights that Bellin Health has under the operating agreement.

The operating agreement contains a non-compete clause. In simple terms, it says Bellin and BAMC are building this entity (NorthReach) together. If one party leaves this partnership, that party may not compete against NorthReach primary care for a term of two years. Bellin hopes to preserve NorthReach and keep the physician-patient relationships intact. Bellin is not seeking to prevent NorthReach physicians from continuing to provide the services they currently provide at BAMC.

Lawsuits and uncertainty oftentimes result in rumor and innuendo. Thank you for the opportunity to set the record straight.

Dear Editor:

This letter is to thank you for printing my victim impact letter in your Wednesday, March 5, 2014 newspaper. It was nice to see that I could be treated with respect even though I have made some mistakes that I am not proud of. This does help with my recovery and my continued work, and dedication to remaining sober and crime free.

Now I have the entire community to hold me accountable for my actions, and this is a responsibility that I gladly welcome. There is no way that I can repay the community and the victims of my crime in full for all of the damage that I have caused, but I will become the model citizen that I should have been years ago. Once again, I apologize to the community for my actions.

Thank you very much for your time and assistance with my new found sobriety.
