Heyer Bail Set At $750,000

The Crivitz man accused of shooting and killing his ex-girlfriend at a gas station in Wausaukee heard the charges against him Wednesday afternoon, Sept. 5. Prosecutors say Richard Heyer, 55, shot Ann Schueller with a rifle at teh Citgo Convenience Store in Wausaukee on Sunday, Aug. 26.

Heyer made his initial appearance in Marinette County Circuit Court via videoconference. Witnesses said Heyer shot himself in the chest after firing on Schueller, but survived. He spent 10 days at a Green Bay hospital before being transported back to Marinette County’s custody earlier. Still dressed in a hospital gown, he appeared with his court-appointed attorney on Sept. 5.

Other than answering a few questions from his attorney, Heyer was relatively motionless and quiet as the judge read him his charges, penalties, and set bail.

Heyer is charged with First Degree Intentional Homicide, which carries the sentence for life imprisonment. The fact that he allegedly used a dangerous weapon in committing this act adds an additional five years to the sentence. The second charge, Possession of Firearm by a Convicted Felon, carries a fine of not more than $25,000 or imprisonment for not more than 10 years, or both. Court records show that Heyer was convicted in 1993 of felony manufacture of a controlled substance, marijuana.

Marinette County District Attorney Allen Brey asked Branch 1 Judge David Miron to set Heyer’s bail high, stating that if the defendant were able to post bail, there was a definite possibility that he may choose to not show up for court.

Brey reasoned, “He apparently shot himself after shooting the victim here. That, to me, weighs heavily into the idea that Mr. Heyer does not wish to participate in these proceedings.”

Brey went on to say that he felt the County had a very strong case against Heyer, mentioning for the first time that surveillance video at the Citgo Station will be used in the prosecution. Added to that, are the two witnesses from the store and Heyer’s admissions during a police interview following the incident.

Brey recommended that bail be set at $750,000.

Heyer’s court-appointed representative, Brad Hanson, Assistant State Public Defender, countered that Heyer has been unemployed for about four years, and that his prior conviction was not a violent offense. He also stated that Heyer still has medical complications and that he can’t travel. Hansen acknowledged that Heyer probably wouldn’t be able to post bail.

Prior to setting bail, Judge Miron stated the charge of First Degree Intentional Homicide is the strongest offense available, and that Heyer is accused of doing a violent act. Miron also acknowledged that there appears to be strong evidence against the defendant. Therefore he agreed that bail should be set in a significant amount, namely $750,000 cash.

After the proceedings, Brey elaborated, “This is the biggest crime we have on the books, and if convicted he could very well be locked up for the rest of his life. That makes him a flight risk. We need to have some certainties he’s going to be here, and if anyone posts that or he posts it, you would think he’d make his court appearances.”

Heyer’s next court date, his initial appearance with formal counsel, is scheduled for 10 a.m. on Monday, Sept. 17. He remains at the Marinette County Jail.
