
Administrative Law Order Handed Down in Mar-Oco Suit Administrative Law Judge Jeffrey D. Boldt published his Findings of Fact Conclusion of Law and Order in the case of a lawsuit filed by Charlie and Colleen DeSmidt and other petitioners against the Mar-Oco Landfill, located at N7785 Shaffer Road, Crivitz.
At an initial hearing, the Petitioners withdrew three petitions related to the operation of a gas extractions system. In addition, the petitioners also ended up withdrawing petitions on dust and odor. The judge also dismissed two petitions related to controlling birds. So the suit was left with just allegations related to daily cover, intermediate cover, windblown debris and screening at the landfill.
This Finding of Fact and Order are just in the remaining allegations. The withdrawn and dismissed allegations may be taken up in another legal arena.
The judge found that the Mar-Oco Landfill did not violate the Code provision related to screening. However, violations of the three other codes were noted. Therefore, Boldt ordered that the DNR enforce the permit provision requiring daily pick-up of windblown debris.
Furthermore, Boldt ordered that the DNR consider imposing more specific permit requirements relating to the collection of windblown debris such as installation of higher and/or redundant fencing within the Landfill perimeter; requiring the employment of part-time personnel solely dedicated to picking up windblown debris; and increased inspections, on up to a quarterly basis, for a period of no less than two years to ensure ongoing compliance with code and permit requirements.
Landfill Director John Lefebvre presented the Findings to the Friday, March 15 meeting of the Mar-Oco Landfill Committee held at the Oconto County Courthouse. The Committee made no comments on the document at this meeting, but it will be discussed as an agenda item at the next Mar-Oco meeting. The Landfills attorney will be present at that meeting, so the discussion may be held in Closed Session.
In other matters, the newest member of the Committee was introduced, Robert Reinhardt of Oconto County. The Mar-Oco Committee is made of three members each from the Marinette and Oconto County Boards.
Lefebvre brought up the request of a company from the valley that recycles mixed demolition waste materials. They are interested in taking such material that gets dropped off at the landfill. In exchange, they would provide the landfill with some cover materials. One of the caveats is that the landfill would either have to stockpile the demolition materials like plaster, roofing, mixed woods and other construction debris on site, or deliver the material to the company.
It is this caveat that caused Lefebvre to pause to check out two things. The first is the financial aspects of the plan, that is, would it be financially advantageous for the landfill. The second is the matter of whether or not the DNR would allow stockpiling of construction debris that is delivered to the landfill.
No decision was made on the request until the above questions are answered.
In a similar vein, Oconto County Supervisor Jim Lacourciere asked if might make sense for the Landfill to get its own wood chipper so that the wood products, once separated, could be reduced and possibly sold to a business that could use it for fuel/heating. More investigation would need to be done.
Updating the landfill operations, Lefebvre reported that 12-year old loader at the site was thought to be developing a starter problem. After taking the unit in for inspection, it was discovered to be a problem with the ring gear. While the engine was taken apart to replace the ring gear, the decision was made to also replace the drive shaft and the ring seal. Some minor repairs were also made to the radiator. The unit is back in operation, but the final bill, which should be around $5,000, has not yet been sent.
The Committee reviewed the schedule of invoices for the month of February, which totaled $6,661.38. The largest item in the vouchers was $4,457.64 for leachate hauling.
